Shipping policy

ARTICLE 1. OBJECT

The purpose of this shipping policy is to define the terms and conditions applicable to the shipment of a Product to the Customer by the Publisher.

ARTICLE 2. PARTIES

This privacy policy is applicable between the publisher of the Site, hereinafter referred to as «the Editor», and any person connecting to the Site, hereinafter referred to as «the User».

ARTICLE 3. DEFINITIONS

“Site Content”: elements of any nature published on the Site, whether or not protected by an intellectual property right, such as texts, images, designs, presentations, videos, diagrams, structures, databases or software.

«Publisher»: Coco Williams Paris, SAS acting as editor of the Site.

“User”: any person logging on to the Site.

“Site”: website accessible at the URL www.coco-williams-paris.fr, as well as the sub-sites, mirror sites, portals and variations of URLs attached thereto.

ARTICLE 4. SCOPE OF APPLICATION

The Site is freely accessible to all Internet users. Browsing the Site implies full and unconditional acceptance of this shipping policy. Any connection to the Site, regardless of the means used (browser, robot, etc.), constitutes acceptance of this policy.

During registration on the Site, this acceptance is confirmed by ticking the corresponding checkbox. This action is considered equivalent to a handwritten signature. The Internet user also acknowledges the evidential value of the Publisher's automatic recording systems and waives the right to contest them unless proven otherwise in case of a dispute.

This shipping policy applies exclusively to the relationships between the parties, excluding any other terms, including those of the Internet user.

Acceptance of this shipping policy requires that Internet users have the necessary legal capacity, or otherwise, have the authorization of a guardian or curator if they are legally incapacitated, a legal representative if they are minors, or a mandate if acting on behalf of a legal entity.


ARTICLE 5. DELIVERY AND SHIPPING

5.1. Delivery Locations

Products are shipped internationally.

5.2. Delivery Fees

Delivery or availability fees will always be indicated to the Customer before any payment and apply only to deliveries made within mainland France, including Corsica. For any other delivery location, the Customer must contact customer service.

If the Product is delivered to a store or a partner location of the Publisher, the related fees will be specified to the Customer at the time of ordering.

The delivery fees listed on the Site are in euros, inclusive of all taxes.

The established delivery fees are as follows:

  • Mainland France: €3.99 standard - €5.99 with signature
  • Belgium, Switzerland, Germany: €8.80 standard
  • French overseas territories: €9.99 standard - €13.99 with signature
  • EU (excluding Belgium and Germany): €22 standard
  • International: €29 standard
  • Free delivery in mainland France and overseas territories for purchases over €80.

5.3. Delivery Time

Orders are delivered via La Poste within 7 business days from the successful payment processing by the Publisher and shipment of the order.

Certain products or order volumes may require a delivery time exceeding 7 business days. This will be expressly indicated to the Customer upon order confirmation.

5.4. Damaged Packages

If a package is visibly damaged upon delivery, the Customer should refuse it to benefit from the carrier’s warranty. Additionally, the Customer must notify the seller immediately so that a new package can be prepared and shipped as soon as the damaged package is returned. In such cases, the previously mentioned delivery times will no longer apply.

5.5. Retention of Ownership - Transfer of Risk

Ownership of the delivered Products remains with the Publisher until they are delivered to the Customer, notwithstanding any contrary clauses, unless both parties expressly agree in writing to waive this clause.

The Customer assumes the risks related to the Products from the moment the order is placed. During the retention period, the Customer must insure the Products at their own expense against any potential damages and provide proof of insurance to the Publisher upon request.


ARTICLE 6. FINAL PROVISIONS

6.1. Applicable Law

This shipping policy is governed by French law.

6.2. Amendments to the Shipping Policy

This shipping policy may be modified at any time by the Publisher. The policy applicable to the Customer is the one in effect on the date of their order or connection to the Site. Any new connection to the personal account implies acceptance of the updated policy, if applicable.

6.3. Disputes

Under Ordinance No. 2015-1033 of August 20, 2015, any dispute with a consumer Customer arising in connection with the execution of these general conditions and not resolved amicably must be submitted to mediation.

Additionally, the consumer Customer is informed of the existence of the Online Dispute Resolution platform, accessible at the following URL:

Since January 1, 2016, mediation has been mandatory for all professionals selling to individuals. Any professional, whether selling remotely or in a physical store, must provide the contact details of a competent mediator in case of a dispute. (Source: FEVAD)

6.4. Entirety

The invalidity of any clause in this contract shall not render the other clauses or the contract as a whole null and void. In such a case, the parties shall, to the extent possible, replace the nullified provision with a valid clause consistent with the spirit and purpose of these terms.

6.5. Non-Waiver

The Publisher’s failure to enforce any of its rights under these terms shall not be interpreted as a waiver of those rights.

6.7. Language of This Shipping Policy

This shipping policy is available in French.

6.8. Unfair Terms

The provisions of this shipping policy apply subject to compliance with the mandatory provisions of the Consumer Code concerning unfair terms in contracts between a professional and a consumer.
